With the improvement of the global level of human rights protection and the innovation of the concept of the adult guardianship, the elderly public guardianship model which has played an important role in China fails to keep pace with the development of the society because of single guardianship mode, being lack of respecting the wishes of the elderly and so on. The design of China's public guardianship system should solve the problem of the relationship between respecting the autonomy of the incapacitated elderly and protecting the rights of the elderly by guardianship in order to prevent the public power from excessively interfering with private rights. Therefore, it is necessary for China to reconstruct the existing model of public guardianship, and implement limited adult guardianship. Also, it is compulsory to provide public legal services and financial support and increase the introduction and training of professionals, that is, the community service model under the supervision of public guardianship agencies and judicial organs.
