Marine compulsory salvage is a special type of marine salvage. It can be defined as “a compulsory service for public interests provided by the local maritime authority to save the ship or other properties in danger”, which is an administrative enforcement at sea. According to the neighbor principle, a ship owes other ships in the same area a duty of care and the mariine casualty is clearly a breach of that duty. The local maritime authority “saves” the potential liability of the ship in danger and thus has the right to claim a reward. The way of claiming it can be made use of a regional salvage fund similar to what is mentioned in the Civil Liability convention.
